This website https://silvestelar.com It is operated by Alejandro Pérez Córdoba (hereinafter, “Silvestelar”, “we”, “us” or “our”).

By accessing this website and/or making a purchase, the user agrees to be bound by these Terms and Conditions , as well as by the policies linked or referenced on the website, including:

Silvestelar will not be responsible for incidents arising from incorrect or incomplete data provided by the user.

5. PRODUCTS, AVAILABILITY AND DESCRIPTIONS

Silvestelar offers products through the website, including personalized and non-personalized products .

We strive to display product information as accurately as possible, but:

  • Images may vary slightly depending on screens or lighting conditions.

  • Colors or finishes may present slight variations inherent to the manufacturing process.

Silvestelar reserves the right to:

  • Modify or remove products

  • Update descriptions and prices

  • Limit purchases for reasonable reasons (fraud, resale, security, etc.)

6. PRICES AND PAYMENTS

Prices shown on the website may change without notice.

Payment is processed through secure gateways offered by Shopify and/or authorized payment providers. Silvestelar does not store complete card details.

7. ORDER PROCESSING

Once the order is confirmed:

  • This enters the preparation and/or customization process.

  • The user will receive communications related to the order status.

Silvestelar reserves the right to cancel orders when there are reasonable indications of fraud or misuse of the system, informing the user when possible.

8. CUSTOMIZED PRODUCTS: SPECIAL CONDITIONS

Customized products are manufactured specifically with the information provided by the customer (image, text or other specifications).

For this reason, the user expressly agrees that:

  • It is not possible to cancel, modify or refund a custom order once it has been confirmed , even if it has not yet been shipped.

  • The personalization process begins immediately after purchase.

  • Customized products cannot be reused or resold to other customers.

In case of manufacturing defect or error attributable to Silvestelar, the provisions of the Refunds and Returns Policy and clause 11 of these Terms will apply, prioritizing the replacement/exchange of the product.

9. SHIPPING

Shipping times and conditions are governed by the current Shipping Policy published on the site.

Delivery times are estimates and not guaranteed , and may be affected by external factors (carriers, customs, holidays, logistics congestion, etc.).

10. RETURNS, EXCHANGES AND REFUNDS

The conditions for returns, exchanges and refunds are governed by the current Refund and Return Policy published on the site.

In case of conflict, the following will always prevail:

  • The policy applicable to the type of product purchased (customized or non-customized)

  • And the specific content of that policy versus general interpretations

11. LEGAL GUARANTEE AND PRODUCT USE

In accordance with Royal Decree-Law 7/2021, of April 27, Silvestelar is responsible for any lack of conformity that becomes apparent within three (3) years from the delivery of the product.

11.1. Warranty Exclusions: Given the handcrafted and personalized nature of our products (jewelry and costume jewelry), the warranty covers only pre-existing manufacturing or material defects. Damages arising from the following are expressly excluded from the warranty:

  • Natural wear and tear: Includes loss of shine, darkening of the metal, or color changes due to the pH of the user's skin or daily use.

  • Friction and rubbing: Surface marks, scratches or wear of the engraving due to contact with other jewelry, keys or surfaces.

  • Tension breaks: Chains, bracelets or clasps that show signs of having been forced, stretched or broken by accidental pulls.

  • Contact with chemical agents: Damage from exposure to perfumes, creams, lacquers, hydroalcoholic gels, abrasive soaps, chlorine or salt water.

  • Improper maintenance: Failure to follow the cleaning and storage recommendations provided on the website.

11.2. Burden of proof: For the first two years after delivery, it will be presumed that any lack of conformity already existed at the time of delivery, unless Silvestelar proves otherwise or that this presumption is incompatible with the nature of the product or the defect. After this period and up to three years, the customer will be responsible for proving that the lack of conformity is inherent and not due to normal use or wear and tear.

11.3. Procedure: To exercise the warranty right, the user must contact us via silvestelar@gmail.com providing clear visual evidence (photos or video) that allows us to assess whether the defect is due to manufacturing or misuse.

This site may contain links to third-party websites. Silvestelar is not responsible for the content, availability, or practices of these external sites.

13. LIMITATION OF LIABILITY

Silvestelar does not guarantee that the website will function uninterrupted or error-free, nor is it liable for:

  • Temporary service interruptions

  • Technical errors beyond their control

  • Viruses or external incidents

Nothing in these Terms limits the consumer's inalienable rights when provided for by applicable law.

14. INTELLECTUAL PROPERTY

All content on this site (text, images, designs, logos, trademarks, structure, etc.) is owned by Silvestelar or licensed third parties and is protected by intellectual and industrial property regulations.

Reproduction, distribution or modification is prohibited without express authorization.

15. PROTECTION OF PERSONAL DATA

The processing of personal data is governed by the Privacy Policy published on the site.

16. MODIFICATIONS TO THE TERMS

Silvestelar may modify these Terms at any time.
The changes will be published on this same page and will be applicable from the date of publication.

17. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish law.

In case of dispute, the parties will submit to the Courts and Tribunals of Spain, unless consumer protection regulations establish another mandatory jurisdiction.
